Overview
Welcome to Maucura. "We", "us" and "our" mean Maucura. These Terms of Service, together with the policies linked from them, set out the rules for using this store: what you can expect from us, and what we expect from you.
Please read them. They include some important parts about your legal rights, particularly the sections on warranties and on limits to our liability.
By visiting or using this store, you agree to these Terms and to our Privacy Policy. If you do not agree to them, please do not use the store.
1. Access and Your Account
By agreeing to these Terms you confirm that you are at least the age of majority where you live, and that you consent to any minors in your care using this store on devices you own or manage.
To shop with us you may need to give us information such as your email address and your billing, payment and shipping details. You confirm that everything you give us is accurate, current and complete, and that you have the right to provide it.
If you create an account, keeping your login details secure is your responsibility, as is everything that happens on your account. You may not transfer, sell, assign or license your account to anyone else.
2. Our Products
We do our best to show our products accurately, but colours and finishes can look different depending on your screen and its settings. We cannot promise that a product's appearance or quality will match what you pictured or exactly match how it appeared on your device.
Product descriptions can change at any time without notice. We may discontinue a product at any time, and we may limit how many of a product we sell to any person, region or jurisdiction.
3. Orders
Placing an order is an offer to buy, not a completed sale. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it. We need to receive and process your payment before we accept an order. Please check your order before submitting it, because we may not be able to act on a cancellation request once an order has been accepted. If we decline, change or cancel an order, we will try to reach you using the email address, billing address or phone number on the order.
Returns and refunds are governed solely by our Refund Policy. Please read it before ordering, as our sales are final except in the circumstances that policy describes.
You confirm that you are buying for your own personal or household use, not for commercial resale or export.
4. Prices and Payment
Prices, discounts and promotions can change without notice. The price you pay is the price in effect when you place the order, and it will be set out in your order confirmation email. Unless we say otherwise, posted prices do not include taxes, shipping, handling, or customs and import charges.
Prices here may differ from prices offered elsewhere, including by third parties. We may run promotions with their own terms, and where those terms conflict with these Terms, the promotion terms win.
Please keep your purchase, payment and account details current and accurate, including your email address and card expiry dates, so that we can complete your orders and reach you when we need to.
When you pay by card, you confirm that the card details you give us are true and complete, that you are authorized to use that card, that your card issuer will honour the charges, and that you will pay the posted price including shipping, handling and any applicable taxes.
5. Shipping and Delivery
Delivery times are estimates, never guarantees. We are not liable for shipping or delivery delays, including delays caused by carriers, customs processing, or anything else outside our control. Once we hand a parcel to the carrier, title and risk of loss pass to you. Our Shipping Policy has the detail.
6. Intellectual Property
This store and everything in it, including trademarks, text, images, graphics, product reviews, video and audio, and the way all of it is designed, selected and arranged, belongs to Maucura, our affiliates or our licensors, and is protected by Canadian and international copyright, trademark and other intellectual property laws.
These Terms let you use the store for your own personal, non-commercial purposes only. Without our written permission you may not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store or transmit any of our material. Nothing here grants you a licence or any other right under any patent, trademark, copyright or other intellectual property belonging to Maucura, Shopify or any third party. All rights we have not expressly granted are reserved.
The Maucura name, logo, product names, designs and slogans are our trademarks and may not be used without our written permission. Shopify's name, logo, product names, designs and slogans are Shopify's trademarks. Everything else belongs to its respective owner.
7. Third-Party Tools
You may be given access to tools provided by third parties through this store. We do not monitor or control them and we have no input into them.
Those tools are provided "as is" and "as available", without warranties, representations or conditions of any kind, and without any endorsement from us. We have no liability arising from your use of them. Using them is entirely at your own risk, so please make sure you are comfortable with the provider's own terms first.
If we add new features or tools in future, they form part of the store and these Terms apply to them too.
8. Links to Other Sites
This store may link to, or embed functionality from, websites run by third parties. We do not review or vet their content or accuracy. If you follow a link away from our store, you do so at your own risk.
We are not liable for any harm or loss connected to your use of third-party websites, or to anything you buy or use there. Please read their policies before transacting with them, and take any complaints or questions about their products and services directly to them.
9. Our Relationship With Shopify
Maucura is powered by Shopify, which enables us to provide this store to you. However, any sales and purchases you make here are made directly with Maucura. By using this store, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Maucura, including any injury, damage, or loss resulting from products and services purchased. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Maucura.
10. Privacy
Any personal information we collect through this store is handled under our Privacy Policy, and some personal information may also be subject to the Shopify Consumer Privacy Policy. By using this store you confirm you have read both.
Because this store is hosted by Shopify, Shopify collects and processes information about how you use it in order to provide and improve the service. What you submit here is shared with Shopify and may reach third parties in countries other than where you live. Our Privacy Policy has the detail.
11. Feedback and Reviews
If you send us ideas, suggestions, feedback, reviews, proposals or any other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium and for any purpose, including commercially. We might use that licence to run, evaluate, improve and promote the store, for example.
You also confirm that you own or have all necessary rights to your Feedback, that you have disclosed any payment or incentive you received for submitting it, and that it complies with these Terms. We are not obliged to keep your Feedback confidential, to pay you for it, or to respond to it.
We may, but do not have to, monitor, edit or remove Feedback we consider unlawful, offensive, threatening, defamatory, obscene, otherwise objectionable, or in breach of anyone's intellectual property or these Terms.
Your Feedback must not infringe anyone's rights, including copyright, trademark, privacy or personality rights, must not be defamatory, abusive, obscene or otherwise unlawful, and must not contain viruses or other malware. Do not use a false email address, impersonate anyone, or otherwise mislead us or others about where Feedback came from. You are solely responsible for your Feedback and its accuracy, and we take no responsibility for Feedback posted by you or anyone else.
12. Errors and Omissions
Occasionally something on this store may contain a typo, an inaccuracy or an omission, whether about a product description, a price, a promotion, a shipping charge, a transit time or availability. We may correct errors and update or change information at any time without prior notice, and we may cancel an order if the information it relied on turns out to be wrong, including after you have placed it.
13. Things You May Not Do
You may use this store for lawful purposes only. You may not use it, directly or indirectly: for any unlawful or malicious purpose; to break any law or regulation, whether municipal, provincial, state, federal or international; to infringe our intellectual property rights or anyone else's; to harass, abuse, insult, harm, defame, intimidate or disparage us or any other person; to transmit false or misleading information; to send or receive material that breaches these Terms; to send junk mail, chain letters, spam or similar solicitations; to impersonate any person or entity; or to do anything else that restricts anyone's use of the store, or that could harm Maucura, Shopify or our customers, or expose any of them to liability.
You also agree not to: upload or transmit viruses or other malicious code; reproduce, duplicate, copy, extract, sell, resell or exploit any part of the store; collect or track other people's personal information; spam, phish, pharm or pretext the store; use any robot, spider, scraper, data extraction tool, AI agent or other automated or manual means to access the store; or interfere with, bypass or circumvent our security measures, robot exclusion headers, or any other controls we use to restrict access.
We may suspend, disable or terminate your account at any time, without notice, if we believe you have breached any part of these Terms.
14. Automated Agents
This section applies if you use, allow, enable or cause the deployment of an Agent to access or interact with this store. "Agent" means any software or service that acts autonomously or semi-autonomously on behalf of, or at the instruction of, a person or entity, and that can run without direct supervision.
No Agent may access or interact with this store unless it identifies itself and operates in line with the requirements below at all times, and no Agent may do so at all once we have asked it to stop. We may limit, including by technical means, whether and how any Agent accesses this store.
Agents must: identify themselves as an Agent in every HTTP or HTTPS request by including "Agent/[agent name]" in the user agent string; not conceal that the activity comes from an Agent, whether by mimicking human behaviour and interaction patterns or by completing or circumventing CAPTCHAs and similar checks; answer truthfully when asked whether they are human or automated; and not circumvent any measure we use to block, limit or control Agent access.
15. Termination
We may end this agreement, or your access to the store or any part of it, at our discretion and without notice. You remain liable for anything you owe us up to and including the date it ends.
These sections survive termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and anything else that by its nature ought to survive.
16. Disclaimer of Warranties
Information on this store is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk. We disclaim all liability arising from reliance on it by you or anyone else.
EXCEPT AS EXPRESSLY STATED BY MAUCURA, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
17. Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL MAUCURA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER CONSUMER PROTECTION LEGISLATION.
18. Indemnification
You agree to indemnify, defend and hold harmless Maucura, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party and arising out of your breach of these Terms or the documents they incorporate, your violation of any law or of anyone's rights, or your use of this store.
We will notify you of any claim covered by this section, though a delay in notifying you will not release you from your obligations unless it materially prejudices you. We may control the defence and settlement of such a claim at your expense, including choosing counsel, but we will not agree to a settlement that imposes non-monetary obligations on you without your consent, which you will not unreasonably withhold. You agree to cooperate in the defence, including by providing relevant documents.
19. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part still applies to the fullest extent the law allows, and the unenforceable portion is treated as severed. The rest of these Terms remain valid and enforceable.
20. Waiver and Entire Agreement
If we do not enforce a right or provision of these Terms, that is not a waiver of it.
These Terms, together with any policies we post on this store, are the entire agreement between you and us about your use of the store, and they replace any earlier agreements, communications or proposals, whether spoken or written, including earlier versions of these Terms.
Any ambiguity in these Terms will not be interpreted against whichever party drafted them.
21. Assignment
You may not delegate, transfer or assign this agreement, or any of your rights or obligations under it, without our written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent and without notice to you.
22. Governing Law
These Terms, and any separate agreement under which we provide you with products or services, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. You and Maucura agree to the exclusive jurisdiction of the courts of Ontario, and to venue there, for any dispute arising out of these Terms, except where applicable consumer protection law gives you the right to bring proceedings in the courts where you live.

24. Changes to These Terms
The current version of these Terms is always on this page.
We may update, change or replace any part of these Terms at our discretion by posting the change to this website, and it is your responsibility to check periodically. We will give notice of material changes as the law requires, and those changes take effect on the date given in the notice. Continuing to use the store after a change means you accept it.
